Catastrophic Injuries

Some injuries change far more than the weeks or months immediately following an accident. A severe injury may affect a person's ability to work, live independently, care for family members, move without assistance, or participate in ordinary activities for years to come. In those cases, understanding the long term consequences can be just as important as determining how the accident occurred.

Michael J. Lucas & Associates, LLC helps clients evaluate serious injury claims with attention to both present losses and future needs.

What Is a Catastrophic Injury?

Catastrophic injury is a practical description rather than a single Illinois cause of action. It often refers to an injury whose consequences are severe, permanent, or life altering. Examples can include traumatic brain injury, spinal cord injury, paralysis, amputation, severe burns, permanent neurological impairment, substantial disfigurement, or serious orthopedic injury.

The diagnosis alone does not define the claim. The central question is what the injury means for the individual person.

Looking Beyond the Immediate Medical Bills

Early hospital bills may represent only a portion of the economic effect of a serious injury. Future consequences can include surgery, rehabilitation, physical or occupational therapy, medications, mobility equipment, home modifications, personal assistance, vocational limitations, or reduced earning capacity.

A careful claim should distinguish between losses that are known and losses that can reasonably be supported by medical, vocational, or financial evidence. Future damages cannot simply be assumed.

The Human Consequences Matter

Severe injuries can affect independence, sleep, concentration, family responsibilities, recreation, relationships, and the ability to perform ordinary activities that previously required little thought.

Illinois personal injury law can permit recovery for noneconomic losses such as pain and suffering, disability, disfigurement, and loss of normal life when supported by the evidence. Those losses often require a detailed understanding of the client's life before and after the injury.

Investigating Responsibility and Insurance

Catastrophic injuries can arise from vehicle collisions, dangerous property conditions, construction incidents, boating accidents, medical negligence, and many other events. The legal theory therefore depends on what caused the injury.

Severe claims can also make insurance coverage especially important. Liability policies, commercial coverage, employer policies, excess coverage, and uninsured or underinsured motorist insurance may need to be examined depending on the case.

How Are Serious Injury Claims Evaluated?

There is no fixed formula. Relevant considerations can include the severity and permanence of the injury, treatment, future medical needs, lost income, diminished earning ability, disability, disfigurement, pain and suffering, loss of normal life, liability evidence, and available insurance.

In appropriate cases, medical providers, vocational professionals, economists, life care professionals, or other qualified experts may help explain future consequences.

If you or a family member has suffered a life changing injury because of another person's conduct, Michael and his team can review the circumstances, help organize the evidence, and explain the legal and insurance issues that may affect the claim.
