Civil litigation

Most disputes should not become lawsuits. The ones that do are usually the ones where the other side was confident nothing would happen.

Michael represents individuals and businesses in contested civil matters — as plaintiff and as defendant — at both the pre-litigation and the litigation stage. The work includes evaluating claims, negotiating disputes, preparing and responding to legal filings, and pursuing or defending lawsuits through to resolution.

Being prepared to litigate changes what happens before litigation. A file assembled as though it will be tried negotiates from a different position than one assembled to be settled quickly, and the difference usually shows up in the terms.

What the work involves

  • Evaluating the strength of a claim or a defense before anything is filed
  • Demand letters, responses and pre-suit negotiation
  • Preparing and responding to complaints, motions and legal filings
  • Discovery — written discovery, document production and depositions
  • Pursuing and defending lawsuits in seven Illinois counties
  • Settlement negotiation and, where appropriate, arbitration or mediation

Plaintiff and defense

Michael handles matters from both sides. Having built claims and defended against them, the value of a case is assessed the way the other side will assess it — which is a more useful starting point than the way a client hopes it will be seen.

Common questions

Call immediately, before the response deadline. A civil summons carries a deadline to appear or answer, and missing it can result in a default judgment entered against you without any consideration of the merits. This is the single most time-sensitive situation on this list.

No, and you should be suspicious of an attorney who says otherwise. The cost of pursuing a matter, the likelihood of collecting on a judgment, and the time involved all factor in. Sometimes the correct advice is that the case is not worth what it will take.

Often, yes — through negotiation, mediation or arbitration. Most matters resolve without a trial. Preparing properly is what makes a good resolution possible.
